A ball hits a car. What is my responsibilty to repair the minor damage?

danglingdamsel asked:

My daughter was playing catch in the front yard with another person…when she threw the ball the other person missed the ball and it hit the neighbors car. He started cussing at my 14 year old daughter because of the dent to the car. Now he wants me to pay for it. It cost $150.00, he only got one estimate. It was a minor dent, his sister even said that she can’t tell where the dent is, you really have to twist your head in various directions to maybe see the dent. I want to know would it be my responsibility to pay for the repair. My financial situation is not good I am barely making it and he knows this too.
It may be “cheap” 4 u guys who don’t have any other responsibilies. $150 for a dent that is not detectable is alot. Plus his car was close to the sidewalk and not parked in closer like he usually does. She didn’t do it with intent and yes it should be the catchers reponsibility too.

  1. Of course it is, and $150 is cheap.

Remember “The Brady Bunch,” “Mom always said, don’t play ball in the house.”

  2. Did he see it happen? I wouldn’t pay for anything if he was swearing at my kids and couldn’t prove they did it. Technically though, I think you are responsible for it.

  3. i’m really sorry but the law is your kid
    your responsibility
    but atleast its only 150
but somepeople don;t really care about how other people survive
    they just pricks

  4. OK at Court the best they would do is look for more estimates. Most places for insurance would want like 2-3. Anyway yeah $150 may be the cost because cars tend to be plastic and you can’t always “pop” a dent out, because then it would just go back in real easy. Old says of metal cars you could pound it out and it would usually stay fine. Anyway YOU are responsible because YOUR child threw the ball. Who do you think should pay? Your child or the one who didn’t catch it? Your child THREW the ball that hit the car.

  5. $150 is not unreasonable for a small autobody repair. You are responsible to pay. I would offer him some cash 1/3 or 1/2 of the money. Explain that you are cash strapped and explain when you can pay the rest. Get a signed receipt for any money or pay by check or money order.

  6. well your neighbor is probably just trying to get the money for himself not the car
im pretty sure he can sue you
but you can counter sue him after that for cursing at your 14 year old daughter and you would probably get at least $1000 because he caused “shock” to your daughter (im sure she herd does word before just play along)
but this would probably cause a neighborhood dispute and you would have to move.

if u cannot pay it all at once, pay it in installments. you should remember that kids learn from what their parents do and if you try to evade your responsibility here, your daughter will be a lesser person for it. also, it’s in your interest to settle this privately rather than for the car owner to take you to court.

  8. If is your responsibility to pay for the damage your daughter caused as she was the one that threw the ball.
